{"id":8471,"date":"2025-05-02T20:27:44","date_gmt":"2025-05-02T18:27:44","guid":{"rendered":"https:\/\/snusforumet.se\/?p=8471"},"modified":"2025-05-08T20:31:00","modified_gmt":"2025-05-08T18:31:00","slug":"spain-pouch-ban-proposal-sparks-swedish-wrath","status":"publish","type":"post","link":"https:\/\/snusforumet.se\/en\/spain-pouch-ban-proposal-sparks-swedish-wrath\/","title":{"rendered":"Spain pouch ban proposal sparks Swedish wrath"},"content":{"rendered":"\n<p><strong>The Swedish government has issued a rare and sharply worded rebuke of Spain\u2019s proposed restrictions that would effectively ban nicotine pouches.<\/strong><\/p>\n\n\n\n<p>In an unusually strong move, Sweden <a href=\"https:\/\/www.regeringen.se\/pressmeddelanden\/2025\/04\/regeringen-lamnar-detaljerat-utlatande-om-spaniens-forslag-att-begransa-forsaljningen-av-vitt-snus\/\">has submitted a formal <em>detailed opinion<\/em><\/a> to the European Commission, arguing that Spain\u2019s draft law violates the EU\u2019s internal market rules and amounts to an unjustified trade barrier.<\/p>\n\n\n\n<p>\u201cWe want to send a signal to remaining EU countries that we are going to stand up for Swedish snusers,\u201d Swedish Trade Minister Benjamin Dousa told the <a href=\"https:\/\/www.expressen.se\/ekonomi\/sverige-tar-strid-for-vitt-snus\/\">Expressen newspaper<\/a> in an interview announcing the move.<\/p>\n\n\n\n<p>Commonly referred to in Sweden as white snus, tobacco-free nicotine pouches have become increasingly popular as well as an important export product for the country, alongside traditional tobacco \u201cbrown\u201d snus.<\/p>\n\n\n\n<p>\u201cWe see that white snus is under attack,\u201d Dousa added.<\/p>\n\n\n\n<p>He called filing the detailed opinion \u201cthe toughest tool we have\u201d to mount a counterattack against policymakers in Brussels and other European capitals aiming to restrict or ban access to safer nicotine alternatives that could potentially save tens of thousands of lives across the EU.<\/p>\n\n\n\n<p>The move drew praise from Patrik Str\u00f6mer, Secretary General of the Association of Swedish Snus Manufacturers.&nbsp;<\/p>\n\n\n\n<p>\u201cSweden\u2019s silence on EU tobacco and nicotine policy was starting to become concerning,\u201d he said.<\/p>\n\n\n\n<p>\u201cIt\u2019s important the government takes a stand to protect consumer choice and an important Swedish industry.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A mounting European crackdown<\/strong><\/h2>\n\n\n\n<p>The Spanish proposal that prompted the Swedish reaction would cap nicotine levels in pouches to an infinitesimal 0.99 milligrams per sachet and ban all flavours except plain tobacco.<\/p>\n\n\n\n<p>The move would in practice eliminate nearly all existing nicotine pouches from the Spanish market. Sweden argues the legislation not only undermines harm reduction principles, but also restricts the free movement of goods within the EU \u2013 a cornerstone of the union\u2019s legal framework.<\/p>\n\n\n\n<p>The warning to Spain comes amid a <a href=\"https:\/\/snusforumet.se\/en\/when-will-europe-overcome-the-current-moral-panic-over-nicotine-pouches\/\">broader trend across the EU<\/a>. Countries including Belgium, the <a href=\"https:\/\/snusforumet.se\/en\/dutch-move-ahead-with-nicotine-pouch-ban\/\">Netherlands<\/a>, Luxembourg, and <a href=\"https:\/\/snusforumet.se\/en\/danish-flavour-ban-fail-nicotine-restrictions-backfire\/\">Denmark<\/a> have introduced bans or severe restrictions on nicotine pouches. France also recently passed similar legislation.<\/p>\n\n\n\n<p>Previously, Sweden has responded to such measures by merely submitting comments \u2013 a lighter form of objection that registers disapproval but carries no legal weight.&nbsp;<\/p>\n\n\n\n<p>But in the case of Spain, Sweden opted for a more powerful instrument. Under EU notification rules, a detailed opinion obliges the receiving member state to pause the legislative process for three months and respond to the concerns raised.<\/p>\n\n\n\n<p>\u201cIt\u2019s partly about protecting the freedoms of Swedish snusers who travel, work, and live in other EU countries,\u201d Dousa told the <a href=\"https:\/\/www.dn.se\/varlden\/regeringen-tar-strid-for-det-vita-snuset-i-bryssel-vart-satt-att-leva\/#:~:text=Regeringen%20tar%20strid%20f%C3%B6r%20det,%3A%20%E2%80%9DV%C3%A5rt%20s%C3%A4tt%20att%20leva%E2%80%9D&amp;text=Att%20snusa%20h%C3%B6r%20till%20svenskarnas,verktyget%E2%80%9D%20som%20finns%20till%20hands.\">Dagens Nyheter newspaper<\/a>.<\/p>\n\n\n\n<p>\u201cBut it\u2019s also about jobs. We have a strong snus industry that employs a lot of people in Sweden.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>More than a trade issue<\/strong><\/h2>\n\n\n\n<p>Sweden has the lowest daily smoking rate in the EU \u2014 just over 5 percent, compared to an EU average of around 22 percent. That achievement is largely credited to the widespread use of snus and, more recently, nicotine pouches.<\/p>\n\n\n\n<p>\u201cSnus is not a health product, but in Sweden, we have fewer smokers and lower lung cancer mortality than the EU average,\u201d Dousa said in a statement.<\/p>\n\n\n\n<p>\u201cTo the extent that snus replaces smoking, it is positive from a public health perspective.\u201d<\/p>\n\n\n\n<p>Spain\u2019s justification for the restrictions centers on youth protection and the addictive properties of <a href=\"https:\/\/snusforumet.se\/en\/nicotine\/\">nicotine<\/a>. Swedish officials acknowledge those concerns but argue they can be addressed through more proportionate means: strict age limits, marketing restrictions, and product labeling, all of which already apply to snus and pouches in Sweden.<\/p>\n\n\n\n<p>\u201cSpain has not demonstrated why such extreme measures are necessary,\u201d the government writes.<\/p>\n\n\n\n<p>\u201cOther EU member states have chosen more measured approaches. The proposal appears arbitrary and risks undermining public confidence in evidence-based regulation.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A broader battle on the horizon<\/strong><\/h2>\n\n\n\n<p>The EU is currently reviewing its <a href=\"https:\/\/snusforumet.se\/en\/the-tobacco-products-directive-a-guide-to-nicotine-legislation-in-the-eu\/\">Tobacco Products Directive<\/a>, adopted in 2014. Although the directive explicitly exempts Swedish snus from EU-wide rules, nicotine pouches fall into a grey area.&nbsp;<\/p>\n\n\n\n<p>With several member states pushing for tougher rules, the coming years could determine whether nicotine pouches remain available across the bloc.<\/p>\n\n\n\n<p>\u201cThis is a defining moment,\u201d says Str\u00f6mer.<\/p>\n\n\n\n<p>\u201cSweden\u2019s public health model works. We\u2019ve proven that harm reduction saves lives.
