Friend Adam Afriyie will be interested to hear that, although snus is currently banned under the regulations, we are undertaking a review and will consider the evidence base,\u201d Churchill said during a <a href=\"https:\/\/hansard.parliament.uk\/Commons\/2021-06-10\/debates\/7A9F973D-6799-4D16-A598-4E47525353B0\/details\">June 10th parliamentary debate<\/a> about an updated UK tobacco control plan.<\/p>\n\n\n\n<p>The statement was hailed as a victory by tobacco harm reduction advocates who have lobbied hard for the UK to abandon the current ban on snus post-Brexit.<\/p>\n\n\n\n<p>\u201cThe original EU snus ban is based on flawed science. It\u2019s high time the UK abandoned the senseless ban on snus now that we are no longer beholden to anti-science Brussels bureaucrats,\u201d said Mark Oates, head of the UK-based <a href=\"https:\/\/twitter.com\/snusassociation?lang=en\">Snus and Nicotine Pouch Users Association<\/a>, who called the snus ban review a \u201cstep in the right direction\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">More calls for UK snus ban review<\/h2>\n\n\n\n<p>Churchill\u2019s June 10th statement comes a matter of weeks after Lord Bethell, who serves as the House of Lords\u2019 health secretary, said that the UK government would \u201creview the evidence\u201d regarding snus to determine \u201cif any future regulatory changes should be considered\u201d.<\/p>\n\n\n\n<p><\/p>\n\n\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Excellent news! It has the ability to help Britain achieve Smoke Free 2030. <a href=\"https:\/\/twitter.com\/hashtag\/SnusSavesLives?src=hash&amp;ref_src=twsrc%5Etfw\">#SnusSavesLives<\/a> <a href=\"https:\/\/twitter.com\/AdamAfriyie?ref_src=twsrc%5Etfw\">@AdamAfriyie<\/a> <a href=\"https:\/\/twitter.com\/DavidJonesMP?ref_src=twsrc%5Etfw\">@DavidJonesMP<\/a> <a href=\"https:\/\/twitter.com\/SnusAssociation?ref_src=twsrc%5Etfw\">@SnusAssociation<\/a> <a href=\"https:\/\/twitter.com\/Jochurchill4?ref_src=twsrc%5Etfw\">@Jochurchill4<\/a> <a href=\"https:\/\/twitter.com\/Eu4Snus?ref_src=twsrc%5Etfw\">@Eu4Snus<\/a> Brexit Dividend <a href=\"https:\/\/t.co\/oz64VHTfPM\">pic.twitter.com\/oz64VHTfPM<\/a><\/p>\n<p>\u2014 Mark Oates (@MOates_) <a href=\"https:\/\/twitter.com\/MOates_\/status\/1402996729864093706?ref_src=twsrc%5Etfw\">June 10, 2021<\/a><\/p>\n<\/blockquote>\n<p> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n<p>Bethell\u2019s comments came in response to <a href=\"https:\/\/questions-statements.parliament.uk\/written-questions\/detail\/2021-03-09\/hl14059\">a question by Viscount Ridley<\/a> about what scientific evidence the government was using to support the snus ban.<\/p>\n\n\n\n<p>Snus remains banned in the UK thanks to 1992 Tobacco for Oral Use (Safety) Regulations, which implemented EU Directive 92\/41 &#8211; and the ban on snus &#8211; into UK law. <\/p>\n\n\n\n<p>The ban has been confirmed in subsequent regulations, most recently by the EU Tobacco Products Directive (TPD) (2014\/40), which was transposed into UK law in 2016 as the Tobacco and Related Products Regulation (TRPR).&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Science &#8216;misused&#8217; in TPD Impact Assessment<\/h2>\n\n\n\n<p>However, the science used in the 2012 Impact Assessment to justify the snus ban back in 2014 has long been criticized.<\/p>\n\n\n\n<p>\u201cIt\u2019s hard to imagine a worse case of evidence being massaged into supporting a pre-determined policy conclusion,\u201d wrote tobacco harm reduction advocate Clive Bates at the time.<\/p>\n\n\n\n<p>Bates, together with Swedish tobacco researcher Lars Ramstr\u00f6m, <a href=\"https:\/\/www.clivebates.com\/documents\/tpdcritiquesnus.pdf\">published a blistering critique<\/a> of the Impact Assessment, stating bluntly that \u201cmainstream scientific opinion does not support the European Commission\u2019s case\u201d for continuing with the ban on snus.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>READ MORE:<\/strong> <a href=\"https:\/\/snusforumet.se\/en\/beating-cancer-clive-bates-on-what-the-eu-got-wrong-about-tobacco\/\"><em>Clive Bates on what the EU got wrong about tobacco<\/em><\/a><\/h4>\n\n\n\n<p>Among other things, they criticized the Commission for failing to take into account views of the WHO Study Group on Tobacco Regulation, Royal College of Physicians, European Monitoring Centre for Drugs and Drug Addiction, as well as a group of 15 respected scientists regarding common standards for product toxicity for smokeless tobacco.<\/p>\n\n\n\n<p>&#8220;Scientific reasoning in the impact assessment has pervasive errors of fact and interpretation, selective use of evidence, important omissions, and poor conceptual framing,\u201d Bates and Ramstr\u00f6m wrote.<\/p>\n\n\n\n<p>\u201cOur critique suggests that science has been misused to justify a predetermined policy, rather than the policy developed on the basis of sound science.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">EU guilty of &#8216;selective&#8217; interpretation of evidence<\/h2>\n\n\n\n<p>And looking at the recently issued <a href=\"https:\/\/ec.europa.eu\/health\/sites\/default\/files\/scientific_committees\/scheer\/docs\/scheer_o_017.pdf\">SCHEER opinion on e-cigarettes<\/a> shows that the EU\u2019s habit of choosing policy-based evidence-making over evidence-based policy-making continues.<\/p>\n\n\n\n<p>\u201cThe primary failure of the SCHEER preliminary scientific opinion is that it does not provide a scientific analysis that is useful to policymakers considering the effect of the Tobacco Products Directive and whether a future revision is necessary,\u201d <a href=\"https:\/\/www.clivebates.com\/response-to-the-extremely-poor-european-commission-scheer-preliminary-opinion-on-e-cigarettes\/\">Bates wrote following its publication<\/a>.<\/p>\n\n\n\n<p>According to Bates, the SCHEER report igores or selectively interprets evidence on smoking cessation and lacks any substantive policy impact research.<\/p>\n\n\n\n<p>\u201cThe most serious failing is the omission of scientific research related to the effect of policies on smoking and vaping behaviour. Policy impact research is the most critical science for policymakers, and it is wholly absent from the preliminary opinion,\u201d he wrote.<\/p>\n\n\n\n<p>Bates wasn&#8217;t alone in his criticism of the science behind the EU&#8217;s SCHEER report. UK health agency Public Health England (PHE) also slammed the EU for poor methodology.<\/p>\n\n\n\n<p>In a <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/962221\/Vaping_in_England_evidence_update_February_2021.pdf\">February 2021 report on vaping in the UK<\/a>, PHE listed a long list of methodological shortcomings in the SCHEER opinon, including failure to follow established guidelines for systematically reviewing evidence and a lack of information specifying the quality of the studies included. <\/p>\n\n\n\n<p>The respected UK health agency also accused the EU of cherry-picking studies included in the SCHEER report, pointing out that the opinion was based on studies carried out before the TPD was in place while at the same time excluding studies published after 2019, leading to a &#8220;reliance on out-of-date data in this quickly moving field&#8221;. <\/p>\n\n\n\n<p>&#8220;Given these methodological concerns and that SCHEER was still carrying out a consultation on this preliminary Opinion at the time of writing, the report is not covered further here,&#8221; PHE wrote in its dismissal of the EU report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">UK will have &#8216;no choice&#8217; but to legalise snus<\/h2>\n\n\n\n<p>However, the recent statements by Churchill and Lord Bethell indicate the UK government is ready to break with the EU\u2019s questionable use of science in developing tobacco policy and instead adopt its own standards and methods for conducting an evidence-based impact assessment regarding snus and other tobacco products.<\/p>\n\n\n\n<p>\u201cThe science on snus is clear.
